<h2>ARTICLE 1 – Scope of application</h2>

These General Terms and Conditions of Sale (hereinafter the “GTC”) apply, without restriction or reservation, to all sales concluded by the company SAS BURNING BAR, a simplified joint stock company with a share capital of 1,000 euros, whose registered office is located at 42 avenue Raymond Poincaré – 75016 Paris, registered with the Paris Trade and Companies Register under number 980 752 562 (hereinafter the “Seller”), with consumers and non professional buyers (hereinafter the “Client”) wishing to purchase the products offered for sale on the website shop.burningbar.fr (hereinafter the “Website”).

These GTC specify in particular the conditions of ordering, payment, delivery and management of possible returns of products ordered by Clients.

Any order placed on the Website implies the Client’s full and unconditional acceptance of these GTC.

These GTC are accessible at any time on the Website and shall prevail over any other document.

<h2>ARTICLE 2 – Products</h2>

The products offered for sale on the Website include in particular:

• hoodies
• sweats
• caps
• accessories

The main characteristics of the products (materials, size, colors, etc.) are presented on the Website.

The Client is required to review this information before placing any order.

The photographs and visuals presented on the Website are provided for information purposes only and are not contractually binding.

The products are offered for sale subject to availability.

<h2>ARTICLE 3 – Delivery territory</h2>

The products are delivered exclusively within metropolitan France (including Corsica).

Any order placed on the Website with a delivery address outside this territory cannot be accepted.

<h2>ARTICLE 4 – Product availability</h2>

Product offers are valid as long as they are visible on the Website and subject to available stock.

In the event of exceptional unavailability of a product after the validation of an order, the Client will be informed as soon as possible and will be refunded the corresponding amount.

<h2>ARTICLE 5 – Orders</h2>

The Client selects the products they wish to order by adding them to their cart.

Before final validation of the order, the Client has the possibility to check the details of the order and correct any errors.

The order is considered final once the Client:

• confirms the cart
• accepts these GTC
• proceeds with payment

An order confirmation email summarizing the order is sent to the Client.

The Seller reserves the right to refuse or cancel any order for legitimate reasons, particularly in the event of an existing dispute with the Client or suspicion of fraud.

<h2>ARTICLE 6 – Pricing</h2>

Prices are indicated in euros (€) and include all applicable taxes (TTC).

Delivery fees are indicated before the order is confirmed.

The Seller reserves the right to modify prices at any time. However, products will be invoiced based on the price in effect at the time the order is validated.

<h2>ARTICLE 7 – Payment</h2>

Payment is due in full at the time of the order.

The accepted payment methods are:

• Visa
• Mastercard
• American Express
• Apple Pay

Payments are secured through the Shopify Payments platform.

The order will only be considered final once payment has been successfully validated.

<h2>ARTICLE 8 – Delivery</h2>

Orders are shipped to the delivery address provided by the Client during the checkout process.

The estimated delivery time is 3 to 5 business days within metropolitan France.

The Seller cannot be held responsible for delays caused by carriers or exceptional circumstances.

The Client must check the condition of the package and the products upon delivery.

Any issue (missing product, damaged package, defective product) must be reported within 3 days by email to:

<h2>ARTICLE 9 – Right of withdrawal</h2>

In accordance with applicable legal provisions, the Client has a period of 14 days from receipt of the order to exercise their right of withdrawal.

Products must be returned:

• unworn
• unused
• in their original packaging

Return shipping costs remain the responsibility of the Client.

After receipt and verification of the returned product, the refund will be issued within a maximum period of 14 days.

<h2>ARTICLE 10 – Legal warranties</h2>

The products benefit from the legal warranties provided under French law:

• the legal guarantee of conformity
• the warranty against hidden defects

In the event of a defective or non compliant product, the Client must contact customer service at the following address:

<h2>ARTICLE 11 – Personal data</h2>

Personal information collected during an order is necessary for processing and delivering the order.

This data may be shared with partners involved in the processing of orders.

The Client has the right to access, modify, rectify and delete their personal data in accordance with applicable regulations.

<h2>ARTICLE 12 – Intellectual property</h2>

All content on the Website (texts, images, logos, graphics, videos, etc.) is the exclusive property of BURNING BAR.

Any reproduction in whole or in part is strictly prohibited without prior authorization.

<h2>ARTICLE 13 – Applicable law</h2>

These GTC are governed by French law.

In the event of a dispute, an amicable solution will first be sought before any legal action.

Failing an amicable agreement, the French courts shall have exclusive jurisdiction.
